The petitioners (decree holders) obtained a decree for possession in O.S. No. 79/2003 (originally O.S. No. 3/1971) against the respondent (judgment debtor). The decree was confirmed up to the High Court. The petitioners filed execution proceedings in E.P. No. 18/2012. During execution, the respondent filed a subsequent suit O.S. No. 22/2016 seeking certain reliefs and filed I.A. No. 12 under Order 21 Rule 29 CPC in the execution proceedings to stay the execution until disposal of the subsequent suit. The executing court allowed the application, staying the execution. The petitioners challenged this order in the High Court under Articles 226 and 227 of the Constitution. The High Court examined the scope of Order 21 Rule 29 CPC, which permits stay of execution only if a suit is pending at the time of filing the execution petition. Since the subsequent suit was filed after the decree and after the execution petition was filed, the condition was not satisfied. The High Court held that allowing the stay would defeat the decree and encourage abuse of process. The impugned order was quashed, and the executing court was directed to proceed with the execution and issue possession warrant forthwith.
