The appellant-claimant, Sri Milind Kunale, filed an appeal under Section 173(1) of the Motor Vehicles Act, 1988, challenging the judgment and award dated 05.09.2019 passed by the VII Additional Senior Civil Judge and ACMM, Member, MACT-3, Bengaluru in MVC No. 698/2018. The claimant was riding a scooter on 18.11.2017 when a water tanker driven rashly and negligently dashed against his vehicle, causing him to fall and sustain injuries. The Tribunal awarded a total compensation of Rs. 1,50,000/- with interest at 6% per annum. The claimant appealed on the ground of inadequacy. The High Court, after considering the evidence and submissions, found that the compensation was on the lower side. The court enhanced the compensation to Rs. 2,50,000/- by increasing the amounts under various heads such as pain and suffering, loss of income during treatment, medical expenses, and future medical expenses. The court directed the insurance company to deposit the enhanced amount with accrued interest within a specified period. The appeal was allowed in part.
