The present writ petition was filed by Hiteshchandra M Bhatt and others, who were appointed as Junior Scientific Assistants (JSA) with the Ahmedabad Municipal Corporation (AMC) between 1979 and 1989. The petitioners sought a writ of mandamus quashing the communication dated 09.03.2017 and directing the AMC to grant them the higher pay scale of Rs. 2000-3200 instead of Rs. 1640-2900, relying on the AMC's circular dated 13.05.2002 which adopted the State Government's circular dated 16.08.1994 regarding higher pay scales. The petitioners argued that the next promotional post, Senior Scientific Assistant (SSA), was not being filled, and they were entitled to the higher pay scale under the Assured Career Progression Scheme. The AMC contended that the circular dated 13.05.2002 was meant for employees who had no promotional avenues, and since the post of SSA was a promotional post available to the petitioners, they were not entitled to the higher pay scale. The court analyzed the Recruitment Rules and found that SSA is indeed a promotional post for JSAs. The court held that the circular dated 13.05.2002 was intended to grant higher pay scale to employees who had stagnated due to lack of promotional opportunities, and since the petitioners had a promotional post available, they were not entitled to the benefit. The court also noted that the petitioners had not been promoted to SSA except for three of them, but that did not change the fact that the post existed. The court dismissed the petition, holding that the petitioners were only entitled to the pay scale of Rs. 1640-2900 as granted by the AMC.
