Case Note & Summary

The present writ petition was filed by Hiteshchandra M Bhatt and others, who were appointed as Junior Scientific Assistants (JSA) with the Ahmedabad Municipal Corporation (AMC) between 1979 and 1989. The petitioners sought a writ of mandamus quashing the communication dated 09.03.2017 and directing the AMC to grant them the higher pay scale of Rs. 2000-3200 instead of Rs. 1640-2900, relying on the AMC's circular dated 13.05.2002 which adopted the State Government's circular dated 16.08.1994 regarding higher pay scales. The petitioners argued that the next promotional post, Senior Scientific Assistant (SSA), was not being filled, and they were entitled to the higher pay scale under the Assured Career Progression Scheme. The AMC contended that the circular dated 13.05.2002 was meant for employees who had no promotional avenues, and since the post of SSA was a promotional post available to the petitioners, they were not entitled to the higher pay scale. The court analyzed the Recruitment Rules and found that SSA is indeed a promotional post for JSAs. The court held that the circular dated 13.05.2002 was intended to grant higher pay scale to employees who had stagnated due to lack of promotional opportunities, and since the petitioners had a promotional post available, they were not entitled to the benefit. The court also noted that the petitioners had not been promoted to SSA except for three of them, but that did not change the fact that the post existed. The court dismissed the petition, holding that the petitioners were only entitled to the pay scale of Rs. 1640-2900 as granted by the AMC.

Headnote

A) Service Law - Assured Career Progression Scheme - Higher Pay Scale - The petitioners, Junior Scientific Assistants, claimed entitlement to higher pay scale of Rs. 2000-3200 as per circular dated 13.05.2002, which adopted the State Government's circular dated 16.08.1994. The court held that the circular dated 13.05.2002 was intended to grant higher pay scale to employees who had stagnated due to lack of promotional avenues, and since the post of Senior Scientific Assistant is a promotional post available to the petitioners, they are not entitled to the higher pay scale under the said circular. (Paras 1-20)

B) Service Law - Promotional Post - Recruitment Rules - The court examined the Recruitment Rules of the respondent Corporation and found that the post of Senior Scientific Assistant is a promotional post for Junior Scientific Assistants. Therefore, the petitioners cannot claim the higher pay scale under the Assured Career Progression Scheme, which is meant for employees without promotional avenues. (Paras 2-15)

C) Service Law - Circular Interpretation - The court interpreted the circular dated 13.05.2002 and held that it was not intended to apply to employees who have a promotional post available. The petitioners' claim for higher pay scale from 01.04.1992 was rejected as the circular itself was issued later and the benefit was not retrospective. (Paras 16-20)

Nature of Litigation

Writ petition under Articles 14, 16 and 226 of the Constitution of India challenging communication dated 09.03.2017 and seeking higher pay scale.

Remedy Sought

Petitioners sought quashing of communication dated 09.03.2017 and direction to grant higher pay scale of Rs. 2000-3200 with consequential benefits from 01.04.1992.

Filing Reason

Petitioners, Junior Scientific Assistants, claimed entitlement to higher pay scale under circular dated 13.05.2002, which was denied by the respondent Corporation.

Issues

Whether the petitioners are entitled to the higher pay scale of Rs. 2000-3200 as per circular dated 13.05.2002? Whether the post of Senior Scientific Assistant is a promotional post for Junior Scientific Assistants?

Submissions/Arguments

Petitioners argued that the circular dated 13.05.2002 adopted the State Government's circular dated 16.08.1994 granting higher pay scale, and since they were not promoted to Senior Scientific Assistant, they were entitled to the higher pay scale. Respondent Corporation argued that the circular dated 13.05.2002 was meant for employees with no promotional avenues, and since the post of Senior Scientific Assistant is a promotional post for Junior Scientific Assistants, the petitioners were not entitled to the higher pay scale.

Ratio Decidendi

The circular dated 13.05.2002 granting higher pay scale is applicable only to employees who have no promotional avenues. Since the post of Senior Scientific Assistant is a promotional post for Junior Scientific Assistants, the petitioners are not entitled to the higher pay scale under the said circular.
