The appeal was filed by the legal heirs of Nileshbhai Mahendrabhai Vasant, who died in a motor accident on 01.04.2011. The deceased was traveling in a car when the driver applied sudden brakes to avoid a bus, causing the car to overturn. He sustained injuries and died on 28.02.2012 after treatment. The claimants sought compensation under Section 166 of the Motor Vehicles Act, 1988. The Tribunal awarded Rs.41,05,240/- with 7.5% interest. Aggrieved by the quantum, the claimants appealed for enhancement. The High Court found that the Tribunal had not considered medical bills of Rs.2,52,899/- and attendant/transportation charges of Rs.1,59,600/-. The Court also held that the consortium amount of Rs.40,000/- per claimant was inadequate and enhanced it to Rs.48,400/- per claimant.
