The petitioner, Jamadar Mehaboob Ghudubai, challenged an order dated 22/08/2016 passed by the Divisional Caste Certificate Scrutiny Committee No.1, Solapur, which invalidated his caste claim as belonging to 'Julah' caste, notified as Other Backward Class (OBC) in Maharashtra. The petitioner professes Islam and claimed that his family traditionally engaged in weaving, the occupation associated with Julah caste. He obtained a caste certificate from the Competent Authority on 12/10/2015 and contested a Gram Panchayat election reserved for backward classes, winning the seat. The Committee referred the claim for vigilance enquiry, which submitted a report dated 07/05/2016 recording statements of elderly residents confirming the petitioner's traditional occupation of weaving and his Julah caste status. Despite this favorable report, the Committee invalidated the claim without providing reasons for disregarding the vigilance report and documentary evidence. The High Court held that the Committee's order was unsustainable as it failed to consider the vigilance report and gave no reasons for its conclusion. The court set aside the impugned order and remitted the matter back to the Committee for fresh consideration, directing it to pass a reasoned order after giving the petitioner an opportunity of hearing.
