Case Note & Summary
The petitioner, Vishnu s/o Kisan Mote, was appointed as an Assistant Teacher with Zilla Parishad, Yavatmal. He applied for admission to the B.Ed. course for the academic session 2016-17 offered by Indira Gandhi National Open University (IGNOU) through its study center. The petitioner passed the written test and received an offer letter dated 22.4.2016. However, he was denied admission on the ground that he did not fulfill the eligibility criteria specified in clause (4) of the offer letter. The petitioner contended that he fulfilled all eligibility criteria, as he possessed a degree with 65.92% marks and had secured a Diploma in Education (D.Ed.) in October 2007 as an in-service candidate while working with Zilla Parishad. The respondents argued that the petitioner did not meet the eligibility criteria. The court examined the advertisement and found that a candidate must possess either a certificate of trained in-service teachers in elementary education or secure a certificate of NCTE recognized teacher education programme through face-to-face mode. The court held that the petitioner, being a trained in-service teacher in elementary education with a D.Ed. degree, satisfied the eligibility criteria. The court found the denial of admission arbitrary and directed the respondents to grant admission to the petitioner for the B.Ed. course. The court also directed that the admission be granted within two weeks and that the respondents would not insist on any further eligibility criteria.
