The petitioner, Vijay Kewalramji Randive, was an employee of Vidarbha Konkan Gramin Bank (the respondent). He was issued a show cause notice on 8 March 2016, to which he replied on 22 March 2016. On 31 March 2016, the bank informed him that since he would retire on that date, the provisions of sub-clauses (3) and (4) of Clause 45 of the Vidarbha Konkan Gramin Bank (Officers and Employees) Service Regulations, 2013 were invoked against him. However, the actual charge-sheet was issued only on 21 April 2016, after his retirement. The petitioner challenged the charge-sheet by way of a writ petition. The petitioner argued that since he had retired on 31 March 2016 and the charge-sheet was issued after that date, the departmental proceedings were not permissible under the Regulations. The respondent bank contended that because the show cause notice was issued before retirement, the proceedings could continue. The court examined Clause 45(3) and (4) of the Regulations, which require that a charge-sheet be issued before the date of retirement to allow continuation of disciplinary proceedings. The court found that the show cause notice alone was insufficient; the charge-sheet itself had to be served prior to retirement. Since the charge-sheet was issued on 21 April 2016, after the petitioner's superannuation, the proceedings were not maintainable. The court allowed the petition, quashed the charge-sheet dated 21 April 2016, and directed the respondents to release all retirement benefits to the petitioner within four weeks.
