On 30 June 2008, the post of Head Master fell vacant due to resignation. On 1 July 2008, respondent nos.1 and 2 appointed respondent no.6, Madhukar Namdeo Jadhav, as In-charge Head Master. The petitioner filed an appeal before the School Tribunal challenging this appointment. The respondents filed an application challenging the jurisdiction of the School Tribunal on the ground that it had no subject matter jurisdiction. The School Tribunal allowed the application and dismissed the appeal. The petitioner then filed a writ petition under Articles 226 and 227 of the Constitution of India.
