The petitioner had submitted documents including Village Extract No.6 and 7/12 Extracts from 1948 in respect of his great grandfather Nagya Hari Pithya, grandfather Gopal Nagya Pithya, father Laxman Gopal Pithya, and uncle Mahadev Gopal Pithya, which showed that these persons held adivasi land and were recorded as 'Mahadev Koli'. Based on the Committee's rejection, the petitioner's employer, Mumbai Port Trust, terminated his services on 2 August 2014. The petitioner filed the present petition on 7 August 2014. The Court noted that the basic submission of the petitioner, as recorded in Ground No.3 of the petition, was that these pre-constitutional documents were not considered by the Committee. The Court held that even one or two supporting documents are relevant and the Committee must take them into consideration before rejecting the claim. The Court quashed the Committee's order and directed it to reconsider the petitioner's caste claim afresh, after giving an opportunity of hearing to the petitioner, within three months from the date of the order. The Court also directed that the petitioner's services be reinstated within two weeks, subject to the outcome of the reconsideration.
