Case Note & Summary

The petitioner, Shri Yamanappa Ramachandrappa Belagal, was appointed as Senior Traffic Manager in Mormugao Port Trust in 2011. In December 2013, a vacancy arose for the post of Traffic Manager (HOD). The Secretary, Government of India, invited applications from eligible officers. Three applications were received and forwarded to the Union of India. On 18/12/2014, an appointment letter was issued to respondent no.3, Shri Vipin R. Menoth, who assumed the role. The petitioner challenged this appointment, arguing that respondent no.3 lacked the requisite experience in the feeder grade as per the Recruitment Rules. The petitioner contended that the Selection Committee's minutes showed respondent no.3 had only three years and four months of experience in the feeder grade, which was insufficient, and that he was credited with grading for periods outside the required timeframe. The respondents filed a compilation of documents related to the selection process. The court, after hearing arguments, noted that the Selection Committee had considered the experience and grading of respondent no.3 and found him eligible. The court held that the Selection Committee is the best judge to assess eligibility and that the petitioner failed to demonstrate any error in the selection process. Consequently, the writ petition was dismissed.
