The petitioner, Ratan Parbat Ahire, was employed as a Cook at a school run by respondent No.1 management. He possessed qualifications of HSC, Typing in English and Marathi, and MSCIT course. Respondent No.4, Lav Ramji Wadvi, was employed as a Peon since 1991 and was HSC passed. In 2008, the post of Junior Clerk fell vacant due to retirement. In 2009, respondent No.4 was promoted to that post. The approval for the promotion was refused by the competent authority, and the Project Officer (respondent No.3) directed an enquiry. The Assistant Project Officer conducted the enquiry and submitted a report dated 17.02.2010 concluding that respondent No.4 could not have been promoted and that the petitioner should have been promoted considering Government Resolutions dated 29.06.1993 and 26.04.1999. The Project Officer passed an order on 23.07.2010 cancelling the promotion of respondent No.4 and directing the management to reconsider. The petitioner filed an appeal before the School Tribunal, Nashik, which was rejected on 23.08.2013. The petitioner then filed the present writ petition. The High Court considered the submissions and found that the School Tribunal had not considered the enquiry report and the Government Resolutions. The court held that the petitioner was entitled to promotion and set aside the Tribunal's order, directing the management to promote the petitioner to the post of Junior Clerk with continuity of service and consequential benefits from the date respondent No.4 was promoted, subject to the petitioner being otherwise eligible.
