The petitioner, Western Coalfields Ltd., challenged an order dated 05.09.2008 passed by the Central Government Industrial Tribunal Cum Labour Court at Nagpur in Case No. CGIT/NGP/102/2002. The Labour Court had declared the action of the petitioner Management as invalid and set it aside. The High Court found that the impugned order was cryptic and vague, did not take into consideration the stand taken by the Management, and no issue was framed regarding the fairness and legality of the enquiry proceedings.
