The petitioner, Maheshkumar Balasaheb Naik, was appointed as a Junior Assistant in 1996 on compassionate grounds after his father's death while in service. He was a physically handicapped candidate from the unreserved category. Over the years, he passed departmental examinations and was promoted to Senior Assistant and later to Office Superintendent. In November 2014, the Chief Executive Officer of Zilla Parishad, Ahmednagar, issued a circular directing all heads of departments to send names of employees appointed from handicapped/hearing impaired/low vision categories for medical re-examination. Pursuant to this, the petitioner was asked to appear before the Civil Surgeon for re-medical examination and submit a fresh medical certificate. Aggrieved, the petitioner filed a writ petition challenging the letter dated 03.01.2015. The court held that the direction for re-medical examination after 18 years of service, without any specific complaint or change in the petitioner's physical condition, was arbitrary and unsustainable.
