Case Note & Summary
The appellant, Dattatray s/o Shankarrao Borgaonkar, proprietor of Shree Industries, a small scale industrial unit, filed three suits (Special Civil Suit No. 1/1999, Special Civil Suit No. 2/1999, and Special Civil Suit No. 3/1999) against the Maharashtra Small Scale Industries Development Corporation Ltd. (MSSIDC) and its officers for recovery of amounts due under contracts for supply of goods and work done. The trial court decreed the suits in favor of the plaintiff, granting the principal amounts with interest at 6% per annum from the date of suit till realization. The defendants appealed to the District Court, which allowed the appeals and dismissed the suits, holding that the suits were barred by limitation and that the plaintiff was not entitled to interest. The plaintiff filed Second Appeals No. 626/2014 and 631/2014, and the Corporation filed Second Appeal No. 151/2015. The High Court of Bombay at Aurangabad heard all three appeals together. The court framed substantial questions of law regarding limitation and interest. After considering the submissions, the High Court held that the lower appellate court had not properly addressed the issue of limitation and had erred in reversing the trial court's decrees without adequate reasoning. The court also noted that the question of interest required fresh consideration. Consequently, the High Court allowed the appeals in part, set aside the judgments of the lower appellate court, and remanded the suits back to the District Court for fresh disposal in accordance with law, directing the lower appellate court to decide the issues of limitation and interest afresh after giving both parties an opportunity to be heard.
