The court allowed the writ petition, quashed the impugned order, and directed the Education Officer to approve the appointment of Shri. Mukta as Headmaster within two weeks. The court also directed that Respondent No.4's seniority and other rights be protected.

Heard the learned counsel appearing for the petitioner, he invited our attention to the resolution passed by the petitioner Management, wherein one Shri. Mukta Shivmurti Manmathappa, was appointed as Headmaster.
Respondent No.4 voluntarily agreed before the Education Officer to give up his claim for the post of Headmaster by promotion, though he was senior most teacher.
In the light of the above, the impugned order cannot be sustained and the same is quashed and set aside.
Procedural History
Petitioner filed Writ Petition No. 166 of 2015 before the Bombay High Court, Aurangabad Bench, challenging the Education Officer's refusal to approve the appointment. The court heard the matter on 16th April 2015 and allowed the petition.
