Case Note & Summary

The case involves a reference under the Code of Criminal Procedure, 1973 for confirmation of the death sentence imposed upon Ramesh Jijeba Lahane by the Additional Sessions Judge, Washim in Sessions Trial No. 51/2012. Ramesh Lahane also preferred a criminal appeal challenging the conviction and sentence. The prosecution case, as unfolded during trial, began on 11 February 2012 when Police Patil Atmaram Kalbande reported a dead body in a well in the agricultural field of Pralhad Kalbande at village Zakalwadi. Police Station Officer Namdeo Rathod (PW 10) registered an accidental death under Section 174 CrPC. He later learnt of a missing person report dated 7 February 2012 concerning Vishwanath Lahane, lodged by his son Shankar. On 12 February 2012, the body was retrieved from the 60-foot-deep well; it was beheaded and the stomach was cut in a straight direction. Shankar identified the deceased by a corn on the leg as his father Vishwanath. Blood was found on the well’s edge and was seized along with other spot evidence. A dog squad was called, photographs were taken, and inquest and spot panchanamas were prepared. Shankar Lahane then lodged an oral report naming Ramesh (the accused), Rameshwar Kalbande, Vitthal Tanpure, and Laxmibai Lahane (the latter was acquitted). Crime No. 18/2012 was registered under Sections 302, 201 r/w 34 IPC. Ramesh was arrested the same day, and two mobile phones were seized from him. Further seizures included blood samples, viscera, a piece of bone, and a jaw found at the spot. On 16 February 2012, while in police custody, Ramesh made a memorandum statement under Section 27 of the Evidence Act, leading to the discovery of a half-filled country liquor bottle and bloodstained clothes from his house, and the place where Vishwanath was allegedly beheaded. The prosecution relied on this evidence to establish Ramesh’s involvement in the gruesome murder and concealment of evidence. The trial court convicted Ramesh and imposed the death penalty, leading to the confirmation proceedings and the instant appeal.
