The appellant-husband, a Parsi by religion, married the respondent-wife on 15th April 1999 according to Hindu vedic rites. They had a son on 4th August 2001. The appellant filed a petition under Section 11 of the Hindu Marriage Act, 1955 seeking a decree of nullity of marriage on the ground that the respondent was a Hindu and had fraudulently concealed her religion, thereby obtaining his consent by fraud. The Family Court dismissed the petition. The appellant appealed to the High Court. The High Court held that the concealment of religion by the respondent amounted to fraud, which vitiated the appellant's consent. The marriage was solemnized under Hindu rites, but the appellant was a Parsi and would not have consented had he known the respondent's true religion. The court allowed the appeal, set aside the Family Court's judgment, and granted a decree of nullity of marriage under Section 11 of the Hindu Marriage Act, 1955.
