The petitioner, Ravindra Murlidhar Kalekar, was appointed as a Sub Engineer (Civil) with the Mumbai Municipal Corporation on 3rd February 1975. He was promoted as Assistant Engineer (Civil) in May 1984. The next promotional post was Executive Engineer (Civil), based on merit and seniority. The Corporation had a promotion policy where ratings were given to employees, and those with poor ratings were considered unfit for promotion. On 18th April 1996, a circular was issued regarding confidential reports. The petitioner claimed that he was entitled to promotion to Executive Engineer (Civil) from 5th December 1997 or from the date his junior was promoted on 7th March 1998. However, the Corporation rejected his request to protect his seniority by an intimation dated 1st March 2005. The petitioner challenged this rejection by way of a writ petition. The court examined the facts and found that the petitioner was not empanelled for promotion due to adverse confidential reports and pending vigilance clearance. The court held that the petitioner could not claim a deemed date of promotion as he was not found suitable for promotion by the Promotion Committee. The court dismissed the petition, upholding the Corporation's decision.
