The petitioner, Anil Tulshiram Sonkusle, was appointed as a Junior Clerk against a Scheduled Tribe vacancy claiming Halba tribe status. He was promoted to Senior Clerk in 1992 and Head Clerk in 2000. His caste claim was invalidated by the Scrutiny Committee on 25.02.2008 based on a Police Vigilance Cell report. He challenged this in Writ Petition No.4690/2010, and a Division Bench remanded the matter for reconsideration on 19.11.2010, directing status quo until the claim is decided. Despite this, respondent no.3 issued a reversion order on 02.06.2014 reverting him to Senior Clerk for non-submission of a validity certificate. The petitioner sought quashing of this order. The court held that the reversion order was illegal as it violated the status quo direction and the matter was pending reconsideration. The court quashed the reversion order and directed the Scrutiny Committee to decide the caste claim within six months, maintaining status quo until then.
