The petitioner, Shyam Janardan Chaoudary, filed a writ petition before the Bombay High Court, Nagpur Bench, aggrieved by the rejection of his application for appointment of a Court Commissioner by the trial court. The court observed that a competent Court Commissioner can draw a map or plan which, if agreed between the parties, would meaningfully assist the trial court. The High Court set aside the impugned order and directed the trial court to appoint a Court Commissioner, preferably the City Surveyor, to draw a map or plan to scale indicating the encroachment, if any. The writ petition was allowed with no order as to costs.
