The appellant, Dhanaji Bhagwan Madne, was convicted under Section 302 IPC for the murder of his wife Vandana. The prosecution case was that the appellant suspected Vandana of having illicit relations with Vithu Gavali and Vitthal Kapse, and he used to abuse and beat her. On 30.5.2010, after attending a marriage, the appellant consumed liquor and continued abusing Vandana. He forced his daughters and PW9 Rajaram to sleep in the courtyard, while he and Vandana slept inside. During the night, Vandana shouted for help, and her daughter Suvarna heard her. The next morning, Vandana was found dead with injuries. The trial court convicted the appellant based on motive, last seen together, and a dying declaration made by Vandana to her daughter. The High Court upheld the conviction, finding that the dying declaration was voluntary and reliable, and the circumstantial evidence formed a complete chain pointing to the appellant's guilt.
