The appellant, Pushpanjali Tie Up Pvt. Ltd., filed a suit alleging that respondent No.1, Renudevi Choudhary, and respondent No.2, Ekta Choudhary (her daughter), had misappropriated shares belonging to the appellant. The appellant claimed that the shares were held in a demat account with respondent No.3, C.D. Equisearch Pvt. Ltd., a stock broker, and that the respondents had fraudulently transferred the shares to their own accounts. The appellant sought an interim injunction restraining the respondents from transferring or dealing with the shares. The learned single Judge dismissed the Notice of Motion for interim relief, holding that the appellant had not made out a prima facie case. The appellant appealed to the Division Bench. The Division Bench allowed the appeal, holding that the appellant had made out a strong prima facie case of fraud and breach of trust.
