Case Note & Summary

The petitioner, Sanjeevan Gramin Vaidyakiya & Samajik Sahayata Pratishthan, a registered public trust and society, runs an Arts, Commerce and Science College at Onde, Thane. The college was granted affiliation by Mumbai University for the first time in the academic year 2002-2003 and became a government-aided institution from 2005-2006. The petitioner applied for permanent affiliation on 14.6.2010. A local inquiry committee (LIC) visited the college on 17.9.2011 and submitted a report on 16.11.2011 highlighting deficiencies in infrastructure and faculty. The University granted time to rectify the deficiencies, but the petitioner failed to comply. Consequently, the BCUD resolved on 26.7.2013, the Academic Council on 19.9.2013, and the University issued a letter on 21.9.2013 withdrawing affiliation. The petitioner challenged these decisions, alleging that the withdrawal was an act of vendetta because its chairman had filed a PIL against the Vice-Chancellor. The court noted that no specific allegations of mala fides were made and no person was impleaded. The court held that the University had followed the procedure under the Mumbai University Act, 1974, and provided sufficient opportunity to the petitioner. The petition was dismissed, and the withdrawal of affiliation was upheld.

Nature of Litigation

Writ petition challenging withdrawal of affiliation of a college by Mumbai University.

Remedy Sought

Petitioner sought quashing of the University's letter dated 21.9.2013, Resolution of Academic Council dated 19.9.2013, and Resolution of BCUD dated 26.7.2013 withdrawing affiliation.

Filing Reason

Petitioner alleged that the withdrawal of affiliation was an act of vendetta due to its chairman filing a PIL against the Vice-Chancellor, and that no opportunity of hearing was given.

Previous Decisions

The University had granted affiliation in 2002-2003 and aided status in 2005-2006. The petitioner applied for permanent affiliation in 2010. A local inquiry committee visited and reported deficiencies. The University granted time to rectify but the petitioner failed, leading to withdrawal.

Issues

Whether the withdrawal of affiliation was valid and in accordance with the Mumbai University Act, 1974. Whether the petitioner was afforded adequate opportunity of hearing before withdrawal. Whether the decision was vitiated by mala fides.

Submissions/Arguments

Petitioner argued that the withdrawal was an act of vendetta because its chairman had filed a PIL against the Vice-Chancellor. Petitioner contended that no opportunity of hearing was given before the withdrawal. Respondent University argued that the procedure under the Act was followed, and the petitioner was given sufficient time to comply with norms.

Ratio Decidendi

The University followed the procedure under the Mumbai University Act, 1974, and provided sufficient opportunity to the petitioner to comply with norms. The allegations of mala fides were not substantiated. Therefore, the withdrawal of affiliation was valid.

Judgment Excerpts

The Supreme Court vide order dated 26.5.2014 in Petition for Special Leave to Appeal (Civil) No. 14120 of 2014 had requested this Court to take up the writ petition for hearing and decide the same before 6.6.2014. There is no dispute that said college was granted affiliation by the Mumbai University for the first time in the academic year 2002-2003 and that said college is a government aided institution since the academic year 2005-2006. At the very outset, it needs to be noted that although the petition is spiced with such statements, there are neither any specific allegations of mala fides nor has any person against whom such allegations been made, impleaded as a party to the petition.

Procedural History

The petitioner filed a writ petition in the Bombay High Court challenging the withdrawal of affiliation. The Supreme Court requested the High Court to decide the matter before 6.6.2014. The petition was heard and disposed of on 2.6.2014.
