The applicant, Ramu Shankar Wagh, was convicted by the Ad hoc Assistant Sessions Judge, Nagpur, for offences under Sections 306 and 498A of the Indian Penal Code (IPC) in Sessions Trial No.409/2002. He was the husband of the deceased Swati, who married him on 26 May 2001. The couple lived separately in a rented room at Mouda, where the applicant worked in private service. The prosecution alleged that the applicant and his two brothers (who were acquitted) demanded Rs.2,000 to Rs.3,000 from the deceased for obtaining a LPG connection and also forced her to work in agricultural fields after domestic chores, causing continuous harassment. Due to this harassment, Swati committed suicide by hanging on 26 March 2002. The complaint was lodged by the deceased's father, Mahadeo. During investigation, the post-mortem confirmed death by hanging with a ligature mark. The trial court acquitted the applicant under Section 304B IPC but convicted him under Sections 306 and 498A IPC. The applicant filed a criminal revision before the Bombay High Court at Nagpur.
