We have carefully considered the order of the State Commission and are of the view that in the given facts and circumstances of the case, delay of 65 days in filing appeal before the State Commission can be condoned and we hereby condone the same and remand the matter back to the State Commission for fresh disposal on merits on the quantum of compensation and litigation cost as awarded by the District Commission. It is reiterated that as the Appellant before us have consented to replace the said monitor with new one having same / similar specifications, State Commission shall not re-open this issue and consider the First Appeal on only a limited aspect whether any compensation and litigation are payable and if yes, the quantum of such compensation and litigation as appellant herein is directed to replace the monitor as per his own undertaking within a maximum of one month from today.
