Case Note & Summary

The plaintiffs, Mrs. Sayeeda Shakur Khan and others, filed a suit against defendants Sajid Phaniband and another seeking a direction to furnish a list of present and past tenants of the suit property and to render true and correct accounts of dealings from 1st April 2002. They also sought appointment of a receiver and an injunction restraining the defendants from alienating or creating third-party rights in the property. The court had earlier passed an ad-interim order restraining the defendants from transferring the property or tenancies and directing them to file a list of tenants and rent receivable. However, the defendants failed to comply with the order. The plaintiffs then filed another notice of motion for appointment of a receiver. The court, considering the non-compliance and the need to protect the property, allowed the appointment of the Court Receiver for the suit property with directions to manage the property, collect rents, and deposit surplus after deducting municipal taxes. The court also directed the defendants to render accounts and pay costs.

Nature of Litigation

Civil suit for rendition of accounts and appointment of receiver in respect of suit property.

Remedy Sought

Plaintiffs sought direction to defendant to furnish list of tenants and render accounts, appointment of receiver, and injunction against alienation.

Filing Reason

Defendant failed to provide list of tenants and accounts as ordered, and there was risk of dissipation of property.

Previous Decisions

Ad-interim order dated earlier restrained defendants from transferring property or tenancies and directed filing of tenant list and rent details.

Issues

Whether a receiver should be appointed for the suit property. Whether defendant should be directed to furnish list of tenants and render accounts.

Submissions/Arguments

Plaintiffs argued that defendant failed to comply with court orders and that appointment of receiver is necessary to protect property. Defendant opposed appointment of receiver, but court found non-compliance and need for receiver.

Ratio Decidendi

Appointment of receiver is justified when a party fails to comply with court orders and there is a risk of dissipation of property or assets, to ensure proper management and accounting.

Judgment Excerpts

During the pendency and till the final disposal of the motion, the defendants are restrained by an order of injunction from transferring the property or transferring any of the tenancies of any of the tenants in the suit property or letting out or creating any new tenancies in the suit property without prior permission of this court.

Procedural History

Plaintiffs filed suit in 2005. Notice of Motion No.885 of 2005 for interim relief was heard and ad-interim order passed. Subsequently, Notice of Motion No.2283 of 2005 for appointment of receiver was filed. Both motions were heard together and disposed of by this judgment.
