Case Note & Summary
The petitioner, Niranjan D. Woody, owned a plot of land in Santacruz with a building containing a residential flat and eight tenants. He availed an overdraft facility of Rs. 25 lakhs from the South Indian Co-operative Bank Ltd. (first respondent) in July 2001, mortgaging the property. The bank initiated recovery proceedings under Section 101 of the Maharashtra Co-operative Societies Act, 1960, and obtained a recovery certificate for Rs. 45,14,081 with interest. The property was attached and auctioned on 14 November 2005 with a reserve price of Rs. 1,23,43,558. The petitioner challenged the auction sale, arguing that the bank failed to follow the mandatory procedure under the Act. The court examined the recovery process and found that the bank did not comply with the requirements of Section 101, particularly regarding the execution of the recovery certificate. The court set aside the auction sale and allowed the petitioner to redeem the mortgage by paying the outstanding dues. The judgment emphasized that the bank's failure to adhere to statutory procedures vitiated the sale.
