The petitioner, Ashwini Anil Chavan, was issued a caste certificate on 25 March 2003 certifying her as belonging to the Thakur Scheduled Tribe. Upon verification by the Scrutiny Committee, the Police Inspector of the Vigilance Cell submitted a report dated 16 April 2005. The Scrutiny Committee, by order dated 15 October 2005, rejected the petitioner's claim on the ground that the affinity test was not fulfilled, relying on the Research Officer's observation that the traits and characteristics of the petitioner did not match the Thakur Scheduled Tribe community. The petitioner challenged this order by way of a writ petition before the Bombay High Court. The main contention was that neither the Vigilance Cell report nor the Scrutiny Committee's order disclosed any application of mind on the affinity test. The Court examined the relevant finding in paragraph 6(a) of the impugned order, which merely stated that the Research Officer had given his observation that the traits did not match, and concluded that the applicant had not succeeded in the affinity test. The Court found merit in the petitioner's submission that the Scrutiny Committee had not considered whether the petitioner fulfilled the requirement of the affinity test. The Court held that the Scrutiny Committee must apply its own mind and not merely reproduce the opinion of the Vigilance Cell. The impugned order was quashed and set aside, and the matter was remitted back to the Scrutiny Committee for a fresh decision in accordance with law, after giving the petitioner an opportunity of hearing.
