The petitioner, Satish Shahaji Fand, was initially appointed as a Class IV employee (Parichar) with the Zilla Parishad, Osmanabad. Subsequently, he was promoted to a Class III post. However, the respondents, including the State of Maharashtra and the Zilla Parishad authorities, denied him the salary and benefits corresponding to the Class III post. Aggrieved, the petitioner filed a writ petition before the Bombay High Court at Aurangabad. The court heard the matter and considered the submissions of the parties. The court observed that once an employee is promoted to a higher post, they are entitled to the salary and benefits of that post from the date of promotion. There was no justification for the respondents to deny such benefits. The court allowed the petition and directed the respondents to grant the petitioner the salary and benefits of the Class III post from the date of his promotion.
