The appellant, a member of the respondent housing society, filed a dispute under Section 91 of the Maharashtra Cooperative Societies Act, 1960 before the Cooperative Court, Amravati, challenging his expulsion from membership and seeking allotment of a plot. The society had cancelled his membership by resolution dated 16.12.1990 and issued a notice of expulsion dated 05.10.1991, claiming he was a defaulter. The Cooperative Court dismissed the dispute on 08.08.2000. On appeal, the Cooperative Appellate Court allowed the appeal, set aside the expulsion resolution and notice, and directed allotment of a plot. The society then filed a writ petition before the Bombay High Court, which was allowed by the learned Single Judge who held that the dispute under Section 91 was not maintainable against an action under Section 35. The appellant appealed by way of Letters Patent Appeal. The Division Bench framed the sole question of maintainability. The Court set aside the order of the learned Single Judge and remanded the matter for decision on merits. The appeal was allowed.
