Respondent No.4, Baburao Saidapure, was appointed on 15.06.1987 and already held a B.Ed. at the time of appointment. The appellant claimed seniority over Respondent No.4 based on his earlier date of appointment. The School Tribunal, in Appeal No.38 of 2010, held that the appellant's seniority should be reckoned from the date he acquired the training qualification (21.05.1986) and not from his initial appointment date. The learned Single Judge of the Bombay High Court confirmed this order in Writ Petition No.8682 of 2011 on 07.08.2012. The appellant filed a Letters Patent Appeal before the Division Bench. The Division Bench, after hearing the parties, upheld the findings of the School Tribunal and the learned Single Judge. Since the appellant was not senior to Respondent No.4 as per the correct seniority list, his challenge to the promotion of Respondent No.4 was rightly rejected.
