Case Note & Summary
The appellant, M/s. DECMAE, a construction firm, filed a suit against the State of Goa and the Executive Engineer, Works Division XVII, for recovery of amounts due under a contract. The trial court partly decreed the suit on 27.12.2007, directing the respondents to pay Rs.2,53,037/- with interest at 6% per annum from 28.06.2003 until payment. The appellant appealed, contending that the respondents had unjustifiably withheld the payment since 2003, causing the appellant to maintain an overdraft facility with Federal Bank at interest rates between 11% and 16% per annum, resulting in substantial financial loss. The appellant sought enhancement of the interest rate and compensation of Rs.2,00,000 per year for the delay. The High Court observed that the respondents had no justification for withholding the payment for such a long period, and the appellant was forced to borrow money at higher interest rates. The court held that the interest rate of 6% was inadequate and enhanced it to 9% per annum from the date of the suit until realization, under Section 34 of the Code of Civil Procedure, 1908. However, the court declined to award separate compensation for delay, as the enhanced interest was deemed sufficient. The appeal was partly allowed, modifying the trial court's judgment only to the extent of the interest rate.
Headnote
A) Civil Procedure - Interest - Enhancement of Interest Rate - Section 34, Code of Civil Procedure, 1908 - The appellant contractor challenged the trial court's award of 6% interest per annum on the decreed amount, arguing that the respondents unjustifiably withheld payment since 2003, causing financial loss due to overdraft interest at 11-16% per annum. The High Court held that the respondents' conduct in withholding payment was unjustified and enhanced the interest rate to 9% per annum from the date of suit till realization, but declined to award separate compensation for delay. (Paras 2-5) B) Contract Law - Compensation - Delay in Payment - Unjust Enrichment - The appellant sought compensation of Rs.2,00,000 per year for delay in payment, but the court found no evidence of any agreement or legal basis for such compensation beyond interest under Section 34 CPC. The court held that the enhanced interest rate adequately compensates for the delay. (Para 5)
