The learned counsel appearing for the appellant has assailed the impugned judgment only on the ground that the respondents have illegally withheld the amount payable to the appellant pursuant to the determination of a sum of Rs.2,53,037/- from the year 2003 which resulted in gross loss to the appellant. The learned counsel further pointed out that as such amount was not received by the appellant an overdraft facility which was availed by the appellant from the Federal Bank had to be kept alive which resulted in paying interest ranging from 11% to 16% per annum. Considering the facts and circumstances of the case, I find that the respondents had no justification to withhold the payment of the said amount for such a long period. In my view, the interest of justice would be met if the interest is enhanced to 9% per annum from the date of the suit till realization.

The appellant filed Civil Suit No. 14/2007 before the District Judge at Panaji for recovery of money. The suit was partly decreed on 27.12.2007. The appellant filed First Appeal No. 82 of 2008 before the High Court of Bombay at Goa challenging the interest rate and seeking compensation.
