The petitioner, Mrs. Charumathi Kannappa Mudaliar, was appointed as an Assistant Trained Teacher at respondent No.4 School, a recognized and aided school, with effect from 7th June 1982. Her appointment was approved by the Education Officer with effect from 7th June 1983, and she was confirmed in service with effect from 13th June 1983. She possessed qualifications of B.A. and B.Ed. (Physical Education & History). She served until her superannuation on 31st October 2009, receiving salary and benefits as an Assistant Trained Teacher throughout her service. Upon retirement, she was entitled to pension, but for about two years no pension was paid. Eventually, pension payments commenced but on the basis that she had superannuated as an Assistant Untrained Teacher, which resulted in a lower pension amount. The petitioner challenged this classification, arguing that her appointment was as a trained teacher and she had always been treated as such. The respondents contended that her B.Ed. qualification was not in the relevant subjects, but the court noted that the appointment was approved and confirmed without any such objection. The court held that since the petitioner was appointed and approved as an Assistant Trained Teacher and served in that capacity, she was entitled to pension in the pay scale of an Assistant Trained Teacher. The court directed the respondents to pay pension and other retiral benefits in the trained teacher scale from the date of retirement, with arrears and interest at 6% per annum.
