Case Note & Summary

The case involves a public trust, Waghur Shikshan Prasarak Mandal, Sakegaon, registered under the Bombay Public Trust Act, 1950. The trust runs schools and a college. The managing committee originally had nine trustees, with Narayansing Patil as President and Musa Patel as Vice President. In 1999, a dispute arose when Narayansing Patil alleged that Musa Patel and others forcibly took trust records. The managing committee expelled Musa Patel and others and filed Change Report No. 430/1999, which was rejected by the Assistant Charity Commissioner (ACC) on 15.03.2000. Narayansing Patil died on 15.08.2000. On 30.08.2000, a meeting was convened by Musa Patel (Vice President) wherein Shakil Patel (son of Musa) was elected as President. Shakil filed Change Report No. 1290/2000, while Deelipsing Patil (nephew of Narayansing) filed Change Report No. 1288/2000 claiming he was elected President on 25.08.2000. The ACC rejected both change reports. Appeals were filed before the Joint Charity Commissioner, who allowed Deelipsing's appeal and remanded the matter regarding expulsion, but dismissed Shakil's appeal. Shakil and Anil Patil filed the present second appeal. The High Court framed substantial questions of law regarding the validity of the meeting held on 30.08.2000 and the condonation of delay. The court held that after the President's death, the Vice President was competent to call a meeting to elect a new President, and the meeting was valid. The court also held that the delay in filing Change Report No. 1290/2000 was condonable. The appeal was allowed, setting aside the orders of the lower authorities and directing the ACC to consider the change report on merits.

Nature of Litigation

Second appeal against orders of Joint Charity Commissioner and Assistant Charity Commissioner regarding change reports in a public trust dispute.

Remedy Sought

Appellants sought setting aside of orders rejecting Change Report No. 1290/2000 and allowing the change report on merits.

Filing Reason

Dispute over election of President after death of previous President; rejection of change report by ACC and dismissal of appeal by Joint Charity Commissioner.

Previous Decisions

ACC rejected Change Report No. 430/1999 (expulsion) on 15.03.2000; ACC rejected Change Report No. 1290/2000 (election of Shakil) and Change Report No. 1288/2000 (election of Deelipsing); Joint Charity Commissioner allowed appeal against rejection of Change Report No. 430/1999 and remanded; dismissed appeal against rejection of Change Report No. 1290/2000.

Issues

Whether the meeting held on 30.08.2000 by the Vice President after the death of the President was valid? Whether the delay in filing Change Report No. 1290/2000 was condonable?

Submissions/Arguments

Appellants argued that after the death of the President, the Vice President was competent to call a meeting and the election of new President was valid. Respondent No. 1 argued that the meeting was not valid as the Vice President had no authority to call a meeting after the President's death and the change report was rightly rejected.

Ratio Decidendi

After the death of the President of a public trust, the Vice President is competent to call a meeting of the managing committee to elect a new President. The meeting held on 30.08.2000 was valid and the election of Shakil Patel as President was not void ab initio. The delay in filing the change report was condonable as it was not intentional.
