The case involves a public trust, Waghur Shikshan Prasarak Mandal, Sakegaon, registered under the Bombay Public Trust Act, 1950. The trust runs schools and a college. The managing committee originally had nine trustees, with Narayansing Patil as President and Musa Patel as Vice President. In 1999, a dispute arose when Narayansing Patil alleged that Musa Patel and others forcibly took trust records. Shakil and Anil Patil filed the present second appeal. The High Court framed substantial questions of law regarding the validity of the meeting held on 30.08.2000 and the condonation of delay. The court held that after the President's death, the Vice President was competent to call a meeting to elect a new President, and the meeting was valid. The court also held that the delay in filing Change Report No. 1290/2000 was condonable. The appeal was allowed, setting aside the orders of the lower authorities and directing the ACC to consider the change report on merits.

Final Decision
The second appeal is allowed. The impugned order dated 31.08.2012 passed by the Joint Charity Commissioner, Nashik in Appeal No. 15/2002 and the order dated 30.06.2001 passed by the Assistant Charity Commissioner, Jalgaon in Change Report No. 1290/2000 are set aside. The matter is remanded to the Assistant Charity Commissioner, Jalgaon for fresh consideration of Change Report No. 1290/2000 on merits in accordance with law, after giving opportunity of hearing to all concerned parties. The Assistant Charity Commissioner shall decide the change report within six months from the date of receipt of the order.
