The petitioner, Shri Anup Prakash Vyas, a student of Bachelor of Architecture (five-year course) at Pune University, passed his first, second, and third year examinations but was declared failed in the fourth and fifth year examinations held in October 2011. The criteria for passing, as per Rule 8 of the University's examination rules, required a candidate to obtain minimum 45% marks in each paper/sessional/viva-voce and 50% in aggregate. The petitioner obtained more than 45% in each paper and his aggregate for the fifth year was above 50%. However, for the fourth year, the total marks were 1300, and 50% thereof is 650.
