Case Note & Summary
The petitioners, Vedansh Hospitality and Resorts Limited and two individuals, were original respondents in an arbitration proceeding initiated by New India Cooperative Bank Ltd. The bank sought recovery of a loan amount of Rs.15,80,25,186.54 with interest. The sole arbitrator, Suresh B. Pawar, passed an award on 13 July 2011 in favor of the bank, directing the petitioners and other respondents to pay the amount jointly and severally with interest at 12.50% p.a. from 01.08.2010. The petitioners challenged the award under Section 34 of the Arbitration and Conciliation Act, 1996 and Section 84 of the Multi-State Cooperative Societies Act, 2002. The court heard the petition finally by consent of the parties. The petitioners argued that the award was vitiated by fraud and violation of natural justice. The court, however, found no merit in these contentions. It held that the scope of interference under Section 34 is limited to grounds of public policy, fraud, or violation of natural justice, and that the petitioners failed to establish any such ground. The court noted that the arbitrator had considered the evidence and passed a reasoned award. The court dismissed the petition, upholding the arbitral award.
