He and the respondent, Sidram Ganpat Ingale, were partners along with five others in a firm named 'M/s. Asian Gas Agency'. A partnership deed was executed on 22.4.1984. The defendant had obtained an agency from Hindustan Petroleum Limited but lacked capital, so the plaintiff and another partner agreed to contribute capital. Eventually, the plaintiff contributed the entire capital. Disputes arose, and on 10.11.1986, the plaintiff's manager informed him that a different lock was found on the firm's shop. The plaintiff alleged that the defendant had broken the lock and taken possession. The plaintiff filed a suit seeking accounts and an injunction. The Trial Court dismissed the suit on 14.2.1991, holding that it was barred by Section 69 of the Indian Partnership Act, 1932 because the firm was not registered. The plaintiff filed a writ petition in the Bombay High Court challenging this dismissal. The High Court examined the provisions of Section 69 and noted that the suit was for enforcement of rights arising from a partnership contract.
