The petitioner, Chandrayya Mutwayya Irabatti, was the original plaintiff in Special Civil Suit No.139 of 1987 filed before the III Joint Civil Judge, S.D., Solapur. He and the respondent, Sidram Ganpat Ingale, were partners along with five others in a firm named 'M/s. Asian Gas Agency'. A partnership deed was executed on 22.4.1984. The defendant had obtained an agency from Hindustan Petroleum Limited but lacked capital, so the plaintiff and another partner agreed to contribute capital. Eventually, the plaintiff contributed the entire capital. Disputes arose, and on 10.11.1986, the plaintiff's manager informed him that a different lock was found on the firm's shop. The plaintiff alleged that the defendant had broken the lock and taken possession. The plaintiff filed a suit seeking accounts and an injunction. The Trial Court dismissed the suit on 14.2.1991, holding that it was barred by Section 69 of the Indian Partnership Act, 1932 because the firm was not registered. The plaintiff filed a writ petition in the Bombay High Court challenging this dismissal.
