Case Note & Summary

The petitioners, nine students, filed a writ petition seeking a direction to respondent no.2 (the examining body) to declare their results for the second and final year of the D.Ed. course and release their marksheets. They were admitted under the Scheduled Tribe category during the academic year 2001-2002. Their caste certificates were pending verification by the Scrutiny Committee. The court noted that the admission was not in dispute and that the students had completed the course. The court held that the students should not be made to suffer due to the pendency of the verification process. It directed respondent no.2 to declare the results and issue marksheets within four weeks, subject to the final decision of the Scrutiny Committee. The writ petition was disposed of with no order as to costs.

Nature of Litigation

Writ petition seeking direction to declare examination results and release marksheets for D.Ed. course.

Remedy Sought

Direction to respondent no.2 to declare results for second and final year of D.Ed. course and release marksheets.

Filing Reason

Petitioners' caste certificates were pending verification by Scrutiny Committee, leading to non-declaration of results.

Issues

Whether students with pending caste certificate verification are entitled to declaration of examination results.

Submissions/Arguments

Petitioners argued that their admission was not in dispute and they had completed the course, so results should be declared. Respondents likely opposed on grounds of pending verification.

Ratio Decidendi

Students admitted under a reserved category whose caste certificates are pending scrutiny cannot be denied declaration of examination results after completing the course; results must be declared subject to final verification.

Judgment Excerpts

The issue being short, we issue rule and by consent of the learned counsel, we dispose of the writ petition finally at this stage. The petitioners, nine in number, have filed this joint writ petition seeking direction to the respondent no.2 to declare their results for the second and final year of D.Ed. course examination and release their marksheets. That the aforesaid petitioners were granted admission under the category of Scheduled Tribe during the academic year 2001-2002 for the D.Ed. course is not in dispute. We, therefore, direct the respondent no.2 to declare the results of the petitioners for the second and final year of D.Ed. course examination and issue marksheets to them within four weeks from today. The declaration of results and issuance of marksheets shall be subject to the final decision of the Scrutiny Committee.

Procedural History

Writ petition filed in 2004; heard and disposed of finally on 17 March 2005.
