The petitioner, Mr. Pandurangrao Laxmanrao Dhongade, was appointed as Librarian in Goa Medical College with effect from 31.8.1974. According to the rules applicable to him at the time of appointment, he ought to retire at the age of 60. In the year 2000, the Government of Goa enacted the Goa State Civil Services (Retirement) Rules, 2000, which were published in the extraordinary Gazette dated 30.8.2000. Rule 3 of these Rules reduced the age of superannuation for certain categories of employees, including the petitioner, from 60 to 58 years. The petitioner filed a writ petition seeking a declaration that Rule 3, insofar as it purports to reduce his age of superannuation from 60 to 58 years, is null and void being violative of Article 14 of the Constitution of India and liable to be struck down or read down as not applicable to librarians working in Goa Medical College. The petitioner argued that the reduction was arbitrary and discriminatory, as teaching staff in the college continued to retire at 60. The respondents, including the State of Goa, the Dean of Goa Medical College, and Goa University, contended that the classification between teaching and non-teaching staff was reasonable and based on intelligible differentia. The Court, after hearing arguments, held that the classification is valid and the Rules are not violative of Article 14. The Court noted that the distinction between teaching and non-teaching staff is well-recognized in service jurisprudence and that the reduction of retirement age for non-teaching staff was a policy decision.
