The petitioner, Neha Achrekar, sought admission to MBA or MMS courses for the academic year 2005-2006 through the State Government's Central Entrance Test (CET). She appeared for the CET in February 2005 and passed. However, at the time of filling the application form, she did not possess a Non-creamy layer certificate required to claim OBC reservation. She obtained the certificate later, before the allotment of students to colleges scheduled for 21st July 2005. The respondent, Directorate of Technical Education, opposed her claim, citing rules that required the certificate to be submitted with the application form. The Court, considering the urgency, issued rule and heard the matter. The Court noted that the rules provided that if supporting documents are insufficient, the application will not be accepted for further processing. However, the Court observed that the petitioner had now obtained the certificate and the allotment process was yet to begin. The Court held that the respondent should consider the petitioner's candidature for OBC seats, as the certificate was available before allotment. The Court directed the respondent to accept the certificate and process her application accordingly. The petition was allowed in those terms.
