The petitioner, Shri D.B. Adagale, was appointed as Head Master of Social Service League High School. Respondent No.1, Smt. Asha Deshpande, challenged this appointment before the School Tribunal, claiming that the Headmaster's post was an isolated post and she, being the seniormost teacher, was entitled to it. The School Tribunal, by judgment dated 17.2.1993, set aside the petitioner's appointment and directed the management to appoint the seniormost member of the teaching staff as Head Master in conformity with Rule 3 of the 1981 Rules under the Maharashtra Employees of Private Schools Act. The petitioner challenged this order by way of a writ petition. The High Court noted that the Tribunal had proceeded on the footing that the petitioner had no right to the post, ignoring that the post could not be termed as an isolated post because there were four schools and a common seniority list was required to be maintained for both the assistant headmaster's and headmaster's posts. In view of the incorrect interpretation by the Tribunal, the High Court set aside the judgment and order of the School Tribunal and allowed the writ petition.
