Case Note & Summary

The appellant, Bashir Nazir Sayyed, was the original plaintiff in a suit against the Brihan Mumbai Municipal Corporation (BMC). He resided and ran a business in a shed made of C.I. sheets and sheet roof admeasuring 8' x 50' in Jira Galli, Bandra (West), Mumbai. He claimed to have been in possession for about 30 years, paying municipal taxes and electricity bills. He had previously filed a suit in 1994 when BMC officers threatened demolition, but withdrew it in 1995 after BMC stated due process would be followed. On 27-9-1995, BMC officers demolished the shed, leading to a contempt petition in which the High Court awarded Rs.10,000/- costs and liberty to reconstruct. Subsequently, on 5-2-1998, BMC issued a notice under Section 314 of the Mumbai Municipal Corporation Act, 1988, threatening demolition again. The plaintiff amended the plaint to allege that the suit premises were on private land of Dr. D'Montee as per municipal assessment bills and had existed since before 1961-62. On 4-4-2001, BMC staff demolished the premises again. The plaintiff sought a declaration that the notice was illegal and a permanent injunction. The City Civil Court dismissed the suit. The High Court upheld the dismissal, holding that the plaintiff failed to prove the structure was on private land; municipal assessment does not confer title or legality. The notice under Section 314 was valid, and the structure being on a street, no injunction could be granted. The appeal was dismissed with no order as to costs.

Headnote

A) Municipal Law - Unauthorized Structure - Section 314 of Mumbai Municipal Corporation Act, 1988 - Validity of Notice - The plaintiff challenged a notice under Section 314 of the Mumbai Municipal Corporation Act, 1988, which threatened demolition of his shed. The court held that the notice was valid as the structure was on a street and not on private land. The plaintiff failed to prove that the structure was on private land or that it was authorized. The court also held that Section 314 does not require a show cause notice before demolition. (Paras 1-10)

B) Evidence - Burden of Proof - Municipal Assessment - The plaintiff relied on municipal assessment bills to show that the suit premises were on private land. The court held that municipal assessment does not prove title or legality of the structure. The burden was on the plaintiff to prove that the structure was on private land, which he failed to discharge. (Paras 5-8)

C) Civil Procedure - Injunction - Permanent Injunction - The plaintiff sought a permanent injunction restraining the defendant from demolishing the suit premises. The court held that since the structure was unauthorized and on a street, no injunction could be granted. The appeal was dismissed. (Paras 9-10)

Nature of Litigation

Civil appeal against dismissal of suit seeking declaration that notice under Section 314 of Mumbai Municipal Corporation Act, 1988 was illegal and for permanent injunction restraining demolition.

Remedy Sought

Appellant sought declaration that notice dated 5-2-1998 under Section 314 was illegal and perpetual injunction against BMC from demolishing suit premises.

Filing Reason

BMC issued notice under Section 314 threatening demolition of appellant's shed; appellant claimed structure was on private land and had existed for decades.

Previous Decisions

Earlier suit (Long Cause Suit No. 5160 of 1994) was withdrawn on 4-7-1995 after BMC stated due process would be followed. Contempt petition filed after demolition on 27-9-1995 resulted in High Court awarding Rs.10,000/- costs and liberty to reconstruct.

Issues

Whether the notice under Section 314 of the Mumbai Municipal Corporation Act, 1988 was illegal and arbitrary. Whether the plaintiff was entitled to a permanent injunction restraining the defendant from demolishing the suit premises.

Submissions/Arguments

Appellant argued that suit premises were on private land of Dr. D'Montee as per municipal assessment bills, existed since before 1961-62, and notice under Section 314 was not a show cause notice and was issued high-handedly. Respondent argued that the structure was on a street and unauthorized; notice under Section 314 was valid and no injunction could be granted.

Ratio Decidendi

The plaintiff failed to prove that the suit premises were on private land; municipal assessment does not prove title or legality. The structure being on a street, the notice under Section 314 of the Mumbai Municipal Corporation Act, 1988 was valid, and no injunction could be granted against demolition of an unauthorized structure.

Judgment Excerpts

The appellant is the original plaintiff... The plaintiff has admitted that he had filed earlier suit... According to the plaintiff, thereafter he received a notice under Section 314 of the Bombay Municipal Corporation Act, 1888... It is the case of the plaintiff that the defendant has not followed the due process of law.

Procedural History

Plaintiff filed Long Cause Suit No. 665 of 1998 in City Civil Court at Bombay seeking declaration and injunction. Suit dismissed on 30-3-2004. Plaintiff appealed to High Court by First Appeal No. 265 of 2003. High Court heard appeal on 12-13 January 2005 and dismissed it.
