The appellant, Bashir Nazir Sayyed, was the original plaintiff in a suit against the Brihan Mumbai Municipal Corporation (BMC). He resided and ran a business in a shed made of C.I. sheets and sheet roof admeasuring 8' x 50' in Jira Galli, Bandra (West), Mumbai. He claimed to have been in possession for about 30 years, paying municipal taxes and electricity bills. He had previously filed a suit in 1994 when BMC officers threatened demolition, but withdrew it in 1995 after BMC stated due process would be followed. On 27-9-1995, BMC officers demolished the shed, leading to a contempt petition in which the High Court awarded Rs.10,000/- costs and liberty to reconstruct. Subsequently, on 5-2-1998, BMC issued a notice under Section 314 of the Mumbai Municipal Corporation Act, 1988, threatening demolition again. The plaintiff amended the plaint to allege that the suit premises were on private land of Dr. D'Montee as per municipal assessment bills and had existed since before 1961-62. On 4-4-2001, BMC staff demolished the premises again. The plaintiff sought a declaration that the notice was illegal and a permanent injunction. The City Civil Court dismissed the suit. The High Court upheld the dismissal, holding that the plaintiff failed to prove the structure was on private land; municipal assessment does not confer title or legality. The notice under Section 314 was valid, and the structure being on a street, no injunction could be granted. The appeal was dismissed with no order as to costs.
