The petitioner, Suresh Ramchandra Gite, was employed as a full-time demonstrator at Respondent No.3 College (Ayurved Mahavidyalaya, Nasik). He obtained an M.D. in Ayurveda in Kaya Chikitsa in October 1991 and was recognized as a post-graduate teacher from 1994 to 1999. In December 1999, the college advertised for teaching staff, and the petitioner applied for the post of Associate Professor in Swasth Vritta. He was initially appointed on 12.6.2000 but was later replaced by Respondent No.5, Dr. Suhas Vaychale. The petitioner filed a writ petition seeking cancellation of Respondent No.5's appointment and his own reappointment. The Director of Ayurveda filed a reply stating that the petitioner did not have the requisite experience in the concerned subject (Swasth Vritta) when the post was advertised, rendering him ineligible. The court, after considering the submissions, found that the petitioner's postgraduate degree was in Kaya Chikitsa, not Swasth Vritta, and he lacked the required experience in Swasth Vritta.
