Under this agreement, the deceased agreed to hand over peaceful and vacant possession of her structure in exchange for a flat in the redeveloped building. The petitioner, after obtaining probate, sought possession of the flat from the respondents. The respondents opposed the motion, arguing that the petitioner was not entitled to possession as the agreement was personal to the deceased and had not been performed. The court examined the facts and held that the probate granted to the petitioner established her title to the estate, including the right to the flat under the tripartite agreement.
