The deceased had died on 10.3.1996, and the petitioner obtained probate of the will from the Bombay High Court on 8.6.1999 in Petition No. 1030 of 1997. One of the properties covered by the will was 'Quinny House', a structure admeasuring 342 sq. ft. on land belonging to respondent no. 2, St. Michael Church. During her lifetime, on 14.5.1993, the deceased had entered into a tripartite agreement with respondent no. 1 (builder, M/s. Suraj Estate Developers Pvt. Ltd.) and respondent no. 2 (landowner) for redevelopment of the property. Under this agreement, the deceased agreed to hand over peaceful and vacant possession of her structure in exchange for a flat in the redeveloped building. The petitioner, after obtaining probate, sought possession of the flat from the respondents. The respondents opposed the motion, arguing that the petitioner was not entitled to possession as the agreement was personal to the deceased and had not been performed. The court examined the facts and held that the probate granted to the petitioner established her title to the estate, including the right to the flat under the tripartite agreement. The court noted that the petitioner, as executrix, was entitled to enforce the agreement and claim possession of the flat.
