Application No.10/97 was dismissed on 5.2.2001. The appellant appealed to the High Court. The High Court heard the appeal and considered two main contentions raised by the appellant's counsel: first, that the Executing Court failed to record evidence as required under Order 21 Rule 97 CPC; second, that the appellant had become a sub-tenant. The High Court noted that the Executing Court had framed issues and the appellant had the burden to prove sub-tenancy, which he failed to do.
