The appeal was filed by the original claimant, Shantappa Rudrappa Mathdevru (since deceased, through his legal representatives), seeking enhancement of compensation awarded by the learned reference court (Civil Judge Senior Division, Kandhar) in Land Acquisition Reference No.22/2005 decided on 23.02.2009. The claimant was the owner of house property bearing Grampanchayat No.85, comprising open space and constructed area, situated at village Marajwadi, Tq. Mukhed, Dist. Nanded. The land was acquired for the Lendi Project. Notification under Section 4 of the Land Acquisition Act, 1894 was published on 23.04.1997 and in Grampanchayat on 23.12.1997. Notice under Section 6 was published in the Government Gazette on 15.12.1998 and in Grampanchayat on 28.03.2000. After following due process, the Special Land Acquisition Officer passed an Award under Section 11 on 26.03.2002, granting compensation of Rs. 63,756/- for the house and Rs. 15,149/- for the open space, totaling Rs. 78,905/-. Dissatisfied, the claimant filed a reference under Section 18, which was forwarded to the Civil Court. The reference court, after considering evidence, enhanced the compensation to Rs. 1,50,000/- for the house and Rs. 50,000/- for the open space, totaling Rs. 2,00,000/-. Still aggrieved, the claimant filed the present appeal. The legal issues were whether the reference court's valuation was proper and whether further enhancement was warranted. The appellant argued that the market value should be higher based on potential value and comparable sales, while the respondents supported the award. The court analyzed the evidence, including the location of the property near a village and its potential for development. Applying the belting method and considering comparable sale instances, the court determined the market value at Rs. 500 per sq.mtr. for open space and Rs. 1,000 per sq.mtr. for constructed area, with a 30% deduction for development.
