The petitioner's counsel sought time to research whether the challenge after seven years was time-barred. The court, after hearing, dismissed the petition, holding that the seniority as per the Supreme Court judgment placed respondent No.1 above the petitioner, and the petition had no merit.

There is no dispute that the Honourable Apex Court has laid down the law on deciding the seniority amongst the trained assistant teachers in the matter of Ku. Bhawana Vs. State of Maharashtra and others, (2019) 4 SCC 300. It is also undisputed that the petitioner acquired her B.Ed. Qualification in 1988 and respondent No.1 had acquired her B.Ed. Qualification in April – 1987. The seniority as a trained assistant teacher in view of the judgment of the Honourable Apex Court would place respondent No.1 above the petitioner.
