The present appeal was filed by the original claimants, legal heirs of Gopal Dilip Pawar, seeking enhancement of compensation awarded by the Motor Accident Claims Tribunal, Latur in M.A.C.P. No.132/2014. The deceased, aged 23 years, was a supervisor with Yogesh Transports, Pune, earning Rs.12,000 per month. On 31.03.2014 at about 4.30 a.m., he was travelling in a pick-up van bearing No.MH 24/J9349 towards Aurangabad for sale of vegetables. Near village Adul, a truck bearing No.AP 04/TU1824 came from the wrong side at high speed and dashed against the pick-up van, causing fatal injuries to Gopal. The claimants filed a claim petition under Section 166 of the Motor Vehicles Act, 1988, seeking compensation, which was restricted to Rs.5,00,000 for court fee purposes. The respondents, including the driver, owner, and insurance company of the offending truck, denied the allegations and contended that the accident was due to negligence of the pick-up van driver. The Tribunal, after considering evidence, awarded compensation of Rs.5,52,000, assessing the deceased's income at Rs.4,500 per month, applying multiplier of 17, and deducting 1/4th towards personal expenses. The claimants appealed for enhancement. The High Court held that the Tribunal's assessment of income at Rs.4,500 was not perverse given lack of documentary proof, but the multiplier should be 18 as per the age of the deceased (23 years), and future prospects at 40% should be added as per the Supreme Court's decision in Pranay Sethi. The court recalculated the compensation: income Rs.4,500 + 40% future prospects = Rs.6,300, minus 1/4th personal expenses = Rs.4,725, multiplied by 12 months and multiplier 18 = Rs.10,20,600. Adding Rs.70,000 for conventional heads (loss of estate, funeral expenses, loss of consortium), total compensation was enhanced to Rs.10,90,600. The insurance company was directed to pay the enhanced amount with interest at 7.5% per annum from the date of petition till realization.
