The Plaintiff, Cargil India Private Limited, a subsidiary of Cargil Inc., is engaged in the business of edible oils and holds copyright in the packaging of its 'GEMINI-Refined Sunflower Oil'. The Defendant, M/s M.M. Oil Enterprises, a proprietary concern of Aslam Noor Mohammad Siddiqui, adopted a deceptively similar trade dress for its product 'GENUINE-Refined Sunflower Oil'. The Plaintiff filed a suit for copyright infringement and passing off in March 2017, and obtained an ex-parte ad-interim injunction on 23rd March 2017 restraining the Defendant from using the impugned packaging. Despite the injunction, the Defendant continued to manufacture and sell products with the infringing packaging. The Plaintiff filed the present Notice of Motion under Order 39 Rule 2-A CPC for contempt of court.
