Case Note & Summary
The petitioner, K.G.H. Dodhiya, joined the New India Assurance Company Limited as a Development Officer on 16 April 1977 and later became an Administrative Officer. On 1 January 2004, the Union of India notified the General Insurance Officers Special Voluntary Retirement Scheme, 2004, which was implemented by the company. The Scheme allowed officers who had attained the age of 40 years and completed 10 years of qualifying service as on 1 January 2004 to apply for voluntary retirement. The petitioner applied on 13 January 2004, but his application was rejected on the ground that he had not completed 10 years of qualifying service. The petitioner challenged this rejection by filing a writ petition. The court examined the eligibility conditions of the Scheme and found that the petitioner had not completed 10 years of qualifying service as on the notified date. The court held that the rejection was justified and dismissed the petition. The court also rejected the argument of legitimate expectation, stating that it cannot override clear eligibility conditions.
Headnote
A) Service Law - Voluntary Retirement Scheme - Eligibility Conditions - General Insurance Officers Special Voluntary Retirement Scheme, 2004 - The petitioner, a Development Officer, applied for voluntary retirement under the Scheme but was rejected on the ground that he had not completed 10 years of qualifying service as on the notified date. The Court held that the eligibility conditions were clear and unambiguous, and the petitioner did not fulfill the requirement of 10 years of qualifying service. The rejection was therefore justified. (Paras 1-10) B) Administrative Law - Judicial Review - Legitimate Expectation - The petitioner argued that he had a legitimate expectation that his application would be accepted. The Court held that legitimate expectation cannot override clear statutory or contractual conditions. Since the petitioner did not meet the eligibility criteria, there was no basis for such expectation. (Paras 11-15)
